Terms & Conditions
Effective Date: September 14, 2026
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. THEY ARE A LEGALLY BINDING AGREEMENT GOVERNING YOUR USE OF THIS WEBSITE AND CONTAIN, IN SECTION 12, A BINDING INDIVIDUAL ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO GO TO COURT AND TO HAVE A JURY DECIDE YOUR CLAIMS.
These Terms and Conditions (the “Terms”) are an agreement between you and Wide Margin Media LLC, a Delaware limited liability company, doing business as BenefitsMoxie (“BenefitsMoxie,” “we,” “us,” or “our”). They govern your access to and use of benefitsmoxie.com and any related pages, features, forms, content, and services that link to these Terms (together, the “Site”). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site.
You agree that our marketing partners and their affiliates (the “Marketing Partners”) are intended third-party beneficiaries of these Terms and the Privacy Policy, and that any right, defense, or protection available to BenefitsMoxie — including the arbitration agreement and class action waiver in Section 12 — is equally available to, and enforceable by, the Marketing Partners with respect to any provision of these Terms or the Privacy Policy in which BenefitsMoxie (or “we,” “us,” or “our”) is referenced.
1. Eligibility and Acceptance
You must be at least 18 years old and able to form a binding contract to use the Site. By using the Site, you represent that you meet these requirements. We may modify these Terms at any time by posting the revised version on the Site; changes apply prospectively, and your continued use after a change means you accept the revised Terms. You should review these Terms each time you use the Site.
2. What BenefitsMoxie Is — and Is Not
BenefitsMoxie operates an advertising-supported referral and comparison service that helps connect interested consumers with third-party offers, advertisers, and Marketing Partners. BenefitsMoxie is not a government agency, insurance company, insurance agency, lender, benefits provider, or financial or insurance advisor, and is not affiliated with or endorsed by any government agency. We do not determine eligibility for, administer, or award any government program or benefit; we do not issue, underwrite, or sell any insurance or financial product; and we do not guarantee that you will qualify for, be approved for, or be offered any product, program, or benefit. We never charge you a fee. Any product or program you obtain is provided by a third party under that party’s own terms, and any decision about it is made by that third party. Information on the Site is for general informational purposes and is not insurance, financial, legal, medical, or tax advice.
3. Telephone and Text Message Consent
When you submit your information through the Site and accept the applicable consent disclosures, you provide your prior express written consent for BenefitsMoxie, the Marketing Partners, and parties acting on their behalf to contact you at the telephone number and email address you provide, for both marketing and non-marketing purposes — including regarding insurance (including Medicare plans), financial and debt services, home services, education, employment, and other benefit and assistance programs — including by automatic telephone dialing system, prerecorded or artificial voice, artificial intelligence technology, and text (SMS/MMS) message. These communications may be recurring. Your consent is not required to make any purchase or to use the Site.
You may revoke your consent at any time: reply STOP to any text message to stop texts, use the unsubscribe link in any marketing email to stop emails, or tell a caller you no longer wish to be contacted. Message and data rates may apply, message frequency varies, and you are responsible for any carrier charges. Because your information may be shared with more than one Marketing Partner, opting out of contact from BenefitsMoxie may not stop contact from a Marketing Partner that separately received your information; you may need to opt out with each directly. We may monitor or record telephone calls for quality, training, and compliance, and you consent to such monitoring and recording.
4. Privacy
Our collection, use, and disclosure of information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you acknowledge the Privacy Policy.
5. Intellectual Property and Limited License
The Site and its content — including text, graphics, layout, design, logos, trademarks, and the selection and arrangement of materials (collectively, “Content”) — are owned by or licensed to BenefitsMoxie and are protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and view the Content for your own non-commercial use. All rights not expressly granted are reserved. You may not use our name, trademarks, or logos without our prior written consent.
6. Acceptable Use
You agree to use the Site only for lawful purposes and not to: violate any law or the rights of others; copy, reproduce, sell, rent, distribute, publicly display, or create derivative works from the Content except as permitted here; use any robot, scraper, crawler, or automated means to access, monitor, or harvest data or content from the Site; collect or store other users’ information; frame the Site or use its trademarks in hidden text or meta tags; reverse engineer or attempt to derive source code; interfere with or circumvent the Site’s security or operation; provide false, inaccurate, or misleading information, or submit information you are not authorized to provide; or impersonate any person or entity. We may suspend or terminate your access for any violation or for any reason in our discretion.
7. Your Submissions
If you submit any content, information, questions, or suggestions to us (“Submissions”), you grant BenefitsMoxie and the Marketing Partners a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, and otherwise exploit the Submission for any purpose, without any obligation or payment to you. You represent that you have the rights necessary to grant this license, and you are responsible for your Submissions. We treat Submissions as non-confidential.
8. Third-Party Content, Links, Advertisers, and Offers
The Site contains advertising and links to websites, offers, products, and services provided by third parties, including Advertisers and Marketing Partners, over which we have no control. We do not endorse, and are not responsible or liable for, any third-party content, offer, product, service, or website, or for your dealings with any third party. Any transaction or interaction you have with a third party — including any product you apply for or obtain — is solely between you and that third party and is governed by that party’s terms and policies. Review them before proceeding.
9. Disclaimers
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS.” TO THE FULLEST EXTENT PERMITTED BY LAW, BENEFITSMOXIE AND ITS AFFILIATES, AND THEIR RESPECTIVE OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS (THE “BENEFITSMOXIE PARTIES”), DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ACCURATE, COMPLETE, CURRENT, OR ERROR-FREE, OR THAT ANY DEFECT WILL BE CORRECTED. WE MAKE NO WARRANTY REGARDING ANY THIRD-PARTY OFFER, PRODUCT, OR SERVICE, AND MAKE NO GUARANTEE THAT YOU WILL QUALIFY FOR OR BE OFFERED ANY PRODUCT. YOU USE THE SITE AND RELY ON ITS CONTENT AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE BENEFITSMOXIE PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATING TO THE SITE, THESE TERMS, OR YOUR INTERACTIONS WITH ANY THIRD PARTY, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE TOTAL AGGREGATE LIABILITY OF THE BENEFITSMOXIE PARTIES FOR ALL CLAIMS RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100). THESE LIMITATIONS ALLOCATE RISK BETWEEN THE PARTIES AND APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
11. Indemnification
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless the BenefitsMoxie Parties and the Marketing Partners from and against any claims, damages, losses, liabilities, judgments, penalties, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: your use of the Site; your Submissions; your violation of these Terms or any applicable law; your provision of any telephone number or other information you are not authorized to provide, including any claim under the Telephone Consumer Protection Act or any state equivalent; your infringement or violation of any third party’s rights; or your dealings with any third party through the Site. We may assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate.
12. Dispute Resolution — Binding Arbitration and Class Action Waiver
Please read this Section carefully. It affects your legal rights.
Agreement to arbitrate. You and BenefitsMoxie agree that any dispute, claim, or controversy arising out of or relating to the Site, the Content, your Submissions, your consent to be contacted, any alleged violation of the Telephone Consumer Protection Act or Do-Not-Call rules, these Terms, or your relationship with us — including disputes involving the Marketing Partners and disputes about the scope or enforceability of this arbitration agreement — will be resolved by final and binding individual arbitration, except as stated below. This arbitration agreement is governed by the Federal Arbitration Act (9 U.S.C. §§ 1–16).
Class action waiver. You and BenefitsMoxie agree that each may bring claims against the other, and against the Marketing Partners, only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any class or representative proceeding. If this class action waiver is found unenforceable, then the entirety of this Section 12 is void.
Informal resolution first. Before starting an arbitration, the complaining party must send the other a written notice describing the dispute and the relief sought — to you, at your most recent contact information on file; to us, at [email protected] and the mailing address in Section 17. The parties will attempt in good faith to resolve the dispute for sixty (60) days after the notice is received. If we do not have current contact information for you, we have no obligation under this paragraph.
Administrator. Arbitration will be administered by JAMS under its applicable rules (for example, its Streamlined Arbitration Rules and Procedures) then in effect, as modified by these Terms, before a single neutral arbitrator. Information about JAMS is available at www.jamsadr.com. BenefitsMoxie will pay the JAMS filing and arbitrator fees for your claim; each party otherwise bears its own attorneys’ fees and costs, unless applicable law provides otherwise.
Proceedings and relief. The arbitrator may award any individual relief that a court could award on an individual basis. The arbitrator’s decision will be in writing and is final and binding, subject only to limited review under the Federal Arbitration Act. Arbitration may proceed by written submissions, telephone or video, or in person at a location JAMS selects that is reasonably convenient to you.
One-year limitation. Any claim must be commenced within one (1) year after it arises, or it is permanently barred, to the fullest extent permitted by law.
Exceptions. Either party may (a) bring an individual claim in small claims court if it qualifies, or (b) seek injunctive or other equitable relief in a court for matters involving intellectual property or the security or integrity of the Site. Bringing such a claim does not waive the arbitration agreement as to other disputes.
Opt-out. You may opt out of this arbitration agreement by sending written notice, within thirty (30) days of your first use of the Site, to [email protected] or the mailing address in Section 17, stating your name, contact information, and that you wish to opt out of arbitration. If you opt out, or if this Section is found unenforceable, disputes will be resolved in the courts described in Section 13. Opting out does not affect the rest of these Terms.
13. Governing Law and Venue
These Terms and any dispute relating to them or the Site are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Subject to Section 12, any dispute not resolved by arbitration (other than a qualifying small claims action) must be brought exclusively in the state courts of the State of Delaware located in New Castle County, or the United States District Court for the District of Delaware, and you consent to the exclusive jurisdiction and venue of those courts.
14. Electronic Communications and E-SIGN Consent
When you use the Site or communicate with us electronically, you consent to receive communications, notices, disclosures, and agreements from us electronically, and you agree that they satisfy any legal requirement that they be in writing. You agree that your electronic submissions and any acceptance you provide through the Site constitute your electronic signature and have the same effect as a handwritten signature. You are responsible for keeping your contact information accurate and current.
15. Changes to the Site and to These Terms
We may modify, suspend, or discontinue all or part of the Site at any time, with or without notice, and we may change these Terms as described in Section 1. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Site.
16. Termination
We may suspend or terminate your access to the Site at any time, for any reason, without notice or liability. Provisions that by their nature should survive termination will survive, including Sections 5 through 13 and 17.
17. General
These Terms and the Privacy Policy are the entire agreement between you and BenefitsMoxie regarding the Site and supersede prior agreements on that subject. We may assign these Terms, in whole or in part, at any time without notice; you may not assign or delegate your rights or obligations without our prior written consent. If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver, and any waiver must be in writing. You are responsible for complying with applicable law, including U.S. export-control and sanctions laws, and you represent that you are not located in, or a resident of, any embargoed jurisdiction or on any U.S. government restricted-party list. Neither party is liable for any delay or failure to perform due to causes beyond its reasonable control, except for payment obligations. Nothing in these Terms creates any agency, partnership, or joint venture between you and BenefitsMoxie.
